What happens when a tax preparer does your taxes wrong?
The Bottom Line
The IRS Penalizes Tax Preparers Who Make Mistakes.
Similar penalties apply under California state law as well. If the IRS determines that your tax preparer made a mistake, this may help you in seeking to avoid fees, penalties, and interest (or having these costs paid by your tax preparer).
The IRS mainly targets people who understate what they owe. Tax evasion cases mostly start with taxpayers who: Misreport income, credits, and/or deductions on tax returns. Don't file a required tax return.
How we calculate the penalty. In cases of negligence or disregard of the rules or regulations, the accuracy-related penalty is 20% of the portion of the underpayment of tax that happened because of negligence or disregard.
A paid tax return preparer is primarily responsible for the overall substantive accuracy of your return and by law, is required to sign the return and include their preparer tax identification number (PTIN) on it.
If you made a mistake on your tax return, you need to correct it with the IRS. To correct the error, you would need to file an amended return with the IRS. If you fail to correct the mistake, you may be charged penalties and interest. You can file the amended return yourself or have a professional prepare it for you.
If you're the victim of return preparer fraud or misconduct, you'll need to show it to the IRS. If the IRS rejects your claim, you may face additional issues, including penalties, interest and any additional tax liability arising from the fraud or misconduct.
The IRS does not check every tax return; in fact, it does not check the majority of them; however, the IRS implements methods that track certain factors that would result in a further examination or audit by them.
Generally, the IRS can include returns filed within the last three years in an audit. If we identify a substantial error, we may add additional years. We usually don't go back more than the last six years. The IRS tries to audit tax returns as soon as possible after they are filed.
Look for email or status updates from your e-filing website or software. If you used USPS Certified Mail or another mail service with tracking, check with them to see if your return was delivered.
Can you sue someone for messing up your taxes?
Tax Return Issues: The Good News
If your accountant refuses to fix any errors or reimburse you for IRS penalties, you may be able to sue your accountant for malpractice and claim those penalties as damages.

Cost: Hiring a tax professional can be expensive, particularly if you have a complex tax situation. Limited control: When you hire a tax professional, you are relying on them to make decisions about your tax return, which can limit your control over the process.
The percentage of individual tax returns that are selected for an IRS audit is relatively small. In 2020, just 0.63% of individual tax returns were selected for audits, or fewer than one out of every 100 returns.
If you discover an error in the H&R Block tax preparation software that entitles you to a larger refund (or smaller liability), we will refund the software fees you paid to prepare that return and you may use our software to amend your return at no additional charge.
Must not fail to return, upon demand by or on behalf of a customer, records or other data provided to the tax preparer by the customer. Must not give false or misleading bond information to a consumer or give false or misleading information to a surety company in obtaining their tax preparer bond.
Math errors are some of the most common mistakes. They range from simple addition and subtraction to more complex calculations. Taxpayers should always double check their math. Better yet, tax prep software does it automatically.
If you filed your return with TurboTax, log into your account and select the tax return that you want to amend and follow the online instructions. For paper-filing amended returns, download a copy of IRS Form 1040-X, Amended U.S. Income Tax Return. You can easily find it at the IRS website.
Most paid tax return preparers are professional, honest and trustworthy. However, the IRS is committed to investigating those who act improperly.
It can apply to each tax benefit claimed on a return. That means if you are paid to prepare a return claiming all three credits and HOH filing status, and you fail to meet the due diligence requirements for all four tax benefits, the IRS may assess a penalty of $560 per failure, or $2,240.
Does the IRS care about small mistakes?
Mistakes on your taxes can trigger audits. You may have to pay fines or fees if you make errors, especially if you were clearly careless. That being said, the IRS isn't as aggressive about this as most people assume. In many cases, they'll just adjust small errors on their end.
Taxable income that is not reported on your tax return is likely to trigger an IRS audit. Common kinds of unreported income include: Income from a hobby or side hustle.
The two groups most likely to get audited are those earning more than $10 million and taxpayers who claim the Earned Income Tax Credit, who tend to be low- or middle-income workers.
The error rate for paper returns is estimated at 21%, whereas it's less than 1% for returns filed electronically -- so if you want to lower your chances of messing up, stay away from paper.
But what are the actual odds of getting audited? Shockingly low for most people. The number of IRS audits has been declining for years. Today, an American's overall chances of being audited are about 1 in 200.
